The following provides you with information about these rights.

Effective Date January 1, 2020, the California Consumer Protection Act of 2018 (CCPA) added certain additional privacy rights to protect Personal Information. CCPA provides consumers with the right to know about the Personal Information we collect about them and the right to have that Personal Information deleted under certain circumstances. The following provides you with information about these rights and about M.J. Hall & Company, Inc. (MJH)’s Privacy Statement, policy or practices. This notice is supplementary to our Privacy Statement. Any California resident who provides MJH with Personal Information during an insurance transaction or a claim is defined as a Consumer.

What Is Personal Information?

This notice pertains to all Personal Information we collect, not just to information that Consumers submit to us via our website.  The CCPA defines Personal Information as information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular customer or household such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol (IP) address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.

Why Does MJH Collect Personal Information?

Personal Information is required and collected for the underwriting of insurance, the adjustment of claims, the processing of insurance related financial transactions, and for our employment purposes. This includes, but is not limited to, all insurance related services, maintaining accounts, providing customer service, issuing policies and endorsements, verifying customer information, processing payments, providing financing, advertising, marketing, conducting risk analytics, internal research for technological development, enforcing the terms and conditions of our policies or agreements, product development, and all employment purposes. We also collect Personal Information to comply with laws and regulations, to investigate fraud, and verify identity.  Consumers who do not wish to provide the Personal Information required for our business and operational purposes are free to decline to provide such information, but may not be able to obtain a policy or make a claim or obtain employment or otherwise engage in the sort of transaction that is dependent upon our receipt of the Personal Information.

Consumers have the Right to Request Information about Personal Information And Ask for Deletion of Personal Information.

The submission of Personal Information to us gives us a right to use this information for our insurance business. Consumers may, however, revoke such consent at any time and request deletion. Any collection or use of Personal Information by us done before the revocation would remain valid. If MJH receives a verifiable request from a Consumer (or a representative of a Consumer) to delete the Consumer’s Personal Information and to direct our service providers to delete Personal Information that we have shared, it shall be deleted, unless the Personal Information is necessary for our  ongoing business relationship with the Consumer, or otherwise necessary to perform a contract, to prevent or protect against fraud, illegal activity, or to comply with a legal obligation. Other exemptions to deletion are enumerated in California Civil Code section 1789.105, and may apply.  

If we receive a verifiable Consumer request from a consumer to access Personal Information, we shall promptly take steps to disclose and deliver, free of charge to the consumer, the Personal Information we collect as described in the CCPA. The information may be delivered by mail or electronically. Subject to the terms and conditions of the CCPA, we will provide Personal Information to a Consumer at any time, but shall not be required to provide Personal Information to a Consumer more than twice in a 12-month period.

What Categories Of Personal Information Does MJH Collect And From What Source Is It collected?

(a)    Underwriting Information includes, but is not limited to, prior and current policy information, and other data about your home or business submitted to us by you or your agent or broker (producers) by way of an application. We collect loss runs, which are claim histories. The application and loss runs may include identity and contact information such as an insured's name, address, geolocation, age, phone number, Social Security number, passport number, assets, income data, marital status, household member identity, or beneficiaries. We may also collect information about your real property by physical and/or web inspections which include information about the ownership, acreage, square footage, building materials, values, home layout and condition, alarm systems, geolocation, fixtures, and business activity at the location. Personal Information may include personal property records, such as automobile descriptors (VIN number, car type and model). Personal Information also includes producer identification and contact information.

(b) Claims Information includes but is not limited to all underwriting information, and information we gather directly or indirectly through field investigators/adjusters relating to a first party or third party claim, including real property documents or tax records, financial records, stock and business personal property inventories, claim history information, documents that describe the age, condition, and value of any property lost or damaged;  information about and from residents or employees; and photos. In the adjustment of bodily injury claims, we collect biometric information, medical and mental health information and health insurance information, professional or employment related information, education information, and we from attorneys involved in the defense or prosecution of a claim, we receive discovery responses, experts’ reports, police reports and statements. Inferences may be drawn from any of the information we collect about a consumer’s characteristics, psychology, behavior, attitudes, intelligence, abilities, and aptitudes.

(c)     Financial Information includes but is not limited to income, payment submissions, payment histories, premium amounts, audits, premium financing, loan and mortgagee information, credit card processing, and other transaction records.

(d)     Consumer and Claim Reporting Information, including but not limited to credit histories and claim histories;

(e)     Technical information including but not limited to your email contact and internet protocol (IP) address, your login data, time zone setting and location (geocodes), logs, pages visited, pages viewed, events and page loads, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website, etc. Profile information will include your username and password, your preferences, and contact information as access to an interactive website becomes available. Your website usage information may include information about how you use our website, and our products and services.

(f)     Employment Information, including job applications and job related financial and benefit information, and health information related to benefits administration or accommodations.

MJH collects information about consumers in the ordinary course of our insurance business, including Personal Information provided by insureds, insurance applicants, agents, brokers, reinsurers, other insurers, claimants, employees, vendors, benefit providers, auditors, investigators, inspectors, attorneys, witnesses, experts, and visitors to our website. The examples of Personal Information and sources above are not meant to be exclusive, but do generally describe the type of information we retain for our business purposes.

What Personal Information Does MJH Disclose Or Share?

We share information to help us underwrite insurance and conduct our business. For example, we may share Personal Information with inspection companies and auditors. We share claims information with Delta Adjusting, our claims consultants, field investigators, experts, and attorneys, but when we do so, we require third parties to protect Personal Information in a manner compliant with the CCPA.

Insurance producers, regulators, reinsurers or counsel retained for our insureds or on our behalf may receive Personal Information that we collect or may provide us with Personal Information. MJH may disclose all or part of your Personal Information when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be violating any agreement with MJH or who may be causing injury to or interference with our rights or property, or anyone else that could be harmed by such activities. We may disclose Personal Information in response to a subpoena, search warrant, in connection with judicial proceedings, or pursuant to court orders, a legal action, or claim management process or other law enforcement measures. MJH may disclose or access Personal Information when we believe in good faith that the law requires it, to establish our legal rights, or to defend against legal claims, and for administrative purposes such as payment processing, data analysis, or any other purposes necessary to the process of our insurance business and customer service. Note that we are required, by law, to report to the Department of Insurance, the Center for Medicare and Medicaid Services and the California Child Support Lien Network.

Discrimination Is Prohibited

MJH will not discriminate against any Consumer because that Consumer exercised his or privacy rights or requested information or deletion to which he or she had a right to request pursuant to the CCPA.

Third Parties And Linked Sites

Our website site contains links to other websites, particularly the USGS website which contains important earthquake information. MJH is not responsible for the privacy practices or the content of any linked websites, including any websites that may indicate a special relationship or partnership with us (such as co-branded pages or “powered by” or “in cooperation with” relationships). We do not share information we gather with other websites or any other entities or individuals unless such sharing is disclosed to you in advance through this Privacy Statement. Other linked websites, however, may collect personal information from you that is not subject to our control. To ensure protection of your privacy, always review the privacy policy of the websites you may visit by linking from the sites. Please note that this Privacy Statement applies only to MJH and not to any other entity’s website or business.

Personal Information Retention

Your Personal Information is retained in a manner consistent with our legal requirements and in according with our Document Retention Policy.  To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your personal information, the purposes for which we collect your Personal Information and whether we can achieve those purposes through other means, and the applicable legal retention requirements. We may retain copies of information about you and any products or services you have used or transactions we have had with you for a period of time that is consistent with applicable law, statute of limitations, or as we believe is reasonably necessary to comply with legal requirements and regulation, legal process or governmental request, detect or prevent fraud, collect fees owed, resolve disputes, address problems, assist with investigations, enforce other applicable agreements or policies, or to take any other actions consistent with applicable law.

In some circumstances we may use your Personal Information for research, predictive risk analytics, product development, or statistical purposes, in which case, we may use this information indefinitely without further notice to you. Any Personal Identifiable Information (PII) such as your name, address, date of birth, telephone number will be deleted in accordance with the retention policy after a defined period of time, but the rest of the data may be kept anonymously and will be used to maintain a level of information that helps us develop products, generally service customers, provide risk management data to insureds, and improve our business.

MJH Does Not Sell Personal Information

Businesses subject to Consumer right to opt-out and compliance requirements are further required to provide a link on their website homepages titled “Do Not Sell My Personal Information” which enables consumer to opt-out of the sale of consumer personal information; however, MJH does not sell Personal Information.
